EvidEpi LLC respects copyright. This page sets out how to notify us of material you believe infringes your rights, how to respond if your material was removed, and what happens to accounts that infringe repeatedly.

What Havast stores, and why that matters here

Havast supplies no assessment instruments and no article content of its own. What is held in an account is uploaded or written by the account holder: the documents they extract from, and the instruments they build. Under our Terms of Use, the account holder confirms they hold the rights necessary to upload each document and to enter any third-party content into an instrument. A notice under this page will therefore normally concern material a user placed in their own account.

Designated agent

EvidEpi LLC has designated an agent to receive notifications of claimed infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(2). The designation is registered with the United States Copyright Office.

Submitting a notice of claimed infringement

To be effective under § 512(c)(3), a written notice sent to the agent above must include substantially the following:

1. A physical or electronic signature of a person authorised to act on behalf of the owner of the exclusive right allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if a single notice covers multiple works at one site, a representative list of them.
3. Identification of the material claimed to be infringing and information reasonably sufficient to let us locate it.
4. Information reasonably sufficient to let us contact you: address, telephone number, and email address.
5. A statement that you have a good faith belief that the use complained of is not authorised by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the owner.

A notice that omits these elements may not be effective, and we may ask you to supply what is missing before we act.

Misrepresentation

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages.

Counter-notification

If your material was removed or access to it disabled and you believe that was a mistake or a misidentification, you may send the agent a counter-notification containing substantially the following:

1. Your physical or electronic signature.
2. Identification of the material and the location at which it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which EvidEpi LLC may be found, and that you will accept service of process from the person who gave the original notice or an agent of that person.

We may replace the removed material, or restore access to it, not less than ten and not more than fourteen business days after receiving a compliant counter-notification, unless our agent first receives notice that an action has been filed seeking a court order to restrain the activity.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. What counts as appropriate depends on the facts, and we consider the substance of the notices received rather than their number alone.
